Draft Law № 15352 on the circulation of commodities associated with deforestation and/or forest degradation has been registered in the Verkhovna Rada of Ukraine. This is one of the key legislative initiatives for the forestry sector, the wood-processing industry, and Ukrainian exporters, as it harmonizes Ukrainian legislation with the requirements of the EU Deforestation Regulation (EUDR) – Regulation (EU) 2023/1115. This was announced by the Head of the State Forest Resources Agency of Ukraine, Viktor Smal.
What the draft law provides for:
Introduction of a national traceability system for commodities associated with deforestation. Products will have to be accompanied by proof of their legal origin, including geolocation data identifying the land plots where the raw materials were harvested.
Mandatory due diligence obligations for operators, traders, and exporters placing such commodities on the market or exporting them.
An electronic product origin verification mechanism based on state information systems, which will automate verification procedures, ensure digital supply chain traceability, and facilitate compliance with EU requirements.
Expansion of the electronic timber accounting system, including timber and timber product certificates of origin, as well as strengthened state oversight.
Amendments to the Forest Code of Ukraine aimed at promoting close-to-nature forestry, improving forest management planning, and enhancing the efficiency of forest resource governance.
According to Viktor Smal, without establishing a transparent traceability system, Ukrainian producers risk losing access to the European Union market. The new EU rules require proof that products are not linked to deforestation or forest degradation. Without such proof, products may be denied access to the EU market.
«At the same time, the adoption of this law is not only about fulfilling Ukraine's international commitments and meeting the requirements of the Ukraine Facility. It is also an opportunity to enhance the competitiveness of Ukrainian products, increase transparency in the forestry sector, strengthen the confidence of international partners, and take another step towards sustainable forest management», - said Viktor Smal.
The draft law has now been submitted to the Verkhovna Rada Committee on Environmental Policy and Nature Management for consideration.
